Terms of Service

These terms cover two things: this website (www.readyfactor.app) and the ReadyFactor readiness platform (go.readyfactor.app). By using either, you agree to them. If you are agreeing on behalf of an organization, you confirm you are allowed to do that.

The pilot

ReadyFactor is in an invite-only pilot. Access is granted individually, by invitation, after a person reviews a request submitted through this site. The pilot is provided free of charge. There is no pricing today, and nothing on this site is an offer to sell you anything.

Because it is a pilot, we may change, add or remove features, and we may end the pilot or an individual organization’s access. If we end your access we will give you a reasonable opportunity to export your readiness reports first, except where we have to act immediately to protect the service or someone else.

Using this website

This website is informational. Its only interactive feature is the invite request form. Submitting it does not create an account or grant access — it starts a review, and we may decline any request.

Accounts and helpers

Coordinators hold accounts and are responsible for keeping their credentials secure and for activity under their account. Helpers join a run through an invite link without creating an account, so anyone holding a run’s link can join that run — treat those links the way you would treat a door code, and ask us to revoke one if it gets out.

If you invite helpers into a run, you are responsible for having a proper basis to do so, and for what your organization records about them.

Your content

The runs, zones, tasks, notes, photos and reports your team creates belong to your organization, not to us. You give us only the permission we need to store, process and display that content in order to operate ReadyFactor for you. We do not use your content to advertise, and we do not sell it.

What ReadyFactor is not

ReadyFactor records what a team says it has done. It is a coordination and record-keeping tool — it is not an inspection, a safety certification, a fire or occupancy sign-off, or any form of professional or legal advice. A readiness report reflects what people entered, and nothing more.

It does not replace your organization’s own safety, compliance, insurance or contractual obligations, and it must not be relied on as the sole basis for deciding that a space is safe to occupy. Those judgments remain yours.

Acceptable use

Don’t use ReadyFactor to break the law or infringe someone’s rights; don’t upload content you have no right to upload; don’t try to access another organization’s data, probe or disrupt the service, or work around its security or rate limits; and don’t resell access. Security researchers acting in good faith should contact us before testing anything, and we will not pursue anyone who does.

Availability, and no warranty

ReadyFactor is under active development. We will do our best to keep it reliable, but during the pilot we cannot guarantee uninterrupted availability, that data will never be lost, or that every feature is finished. The service is provided “as is” and “as available”, without warranties of any kind, to the fullest extent the law allows.

Keep your own copy of anything you cannot afford to lose. Readiness reports can be printed or saved as PDF, and we recommend doing that for any run that matters.

Liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, lost data, or business interruption, arising from your use of ReadyFactor. Because the pilot is free, our total liability to you is limited to one hundred US dollars.

Nothing here excludes liability that cannot legally be excluded, including for fraud, or for death or personal injury caused by negligence.

Ending it

You can stop using ReadyFactor at any time, and ask us to delete your organization’s data. We may suspend or end access if these terms are broken, or if we end the pilot. The sections that by their nature should outlive the agreement — your content ownership, the disclaimers, and liability — continue to apply.

Changes

We may update these terms as the product and pilot evolve, and will change the date at the top when we do. For a material change we will tell pilot organizations directly rather than relying on you to re-read this page. Continuing to use ReadyFactor after a change means you accept it.

Governing law

These terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in or serving Saratoga County, New York, and both sides consent to the jurisdiction of those courts.
